厚生労働省は9月から、労働基準監督署による残業削減の指導を見直します。これまでは、月100時間未満まで残業が可能な企業にも「月45時間以内に抑えてください」と一律に求めていました。
From September, the Ministry of Health, Labour and Welfare will revise the guidance given by Labor Standards Inspection Offices on reducing overtime. Until now, even companies allowed overtime of under 100 hours per month were uniformly told to keep it within 45 hours.
9月からは、この一律の指導をやめます。代わりに、企業が健康確保のための措置をきちんと実施しているかを重点的に確認します。法律上の残業の上限自体は変わりません。
From September this uniform guidance will stop. Instead, the focus will be on whether companies are properly implementing measures to protect workers’ health. The legal upper limits on overtime themselves will not change.
労働基準法では、原則として1日8時間・週40時間が上限です。36協定を結べば月45時間まで、特別条項を付ければ月100時間未満まで残業が可能になります。今回の見直しは「指導の仕方」が変わるだけで、法律の上限は同じです。
Under the Labor Standards Act, the basic limit is 8 hours a day and 40 hours a week. With a “36 Agreement,” overtime up to 45 hours a month is allowed; with a special clause, it can go up to under 100 hours a month. This revision only changes the style of guidance; the legal limits remain the same.
企業側は柔軟な対応を歓迎する声がありますが、労働者側からは「長時間労働が増えるのではないか」という不安も出ています。働き方はこれからどう変わるのか、注目されています。
Some companies welcome the more flexible approach, but workers have expressed concern that long working hours may increase. Attention is focused on how working styles will change from now on.
